Legislation for road safety Abstract A summary of the resource. มาตรการทางกฎหมายเพื่อถนนปลอดภัย กฎหมายเป็นเครื่องมือที่สำคัญต่อการป้องกันอุบัติเหตุทางรถยนต์ ด้วยการควบคุมพฤติกรรมผู้ใช้ถนนและการจัดสรรทรัพยากรของรัฐเพื่อการดำเนินกิจกรรม กฏหมายนอกจากใช้ควบคุมพฤติกรรมผู้ใช้ยานพาหนะแล้วยังบังคับให้ผู้ประกอบการที่ผลิตหรือประกอบรถยนต์ต้องพัฒนาสินค้าคำนึงถึงความปลอดภัยมากขึ้น ทั้งๆที่ประเทศไทยมี พรบ สามฉบับที่เกี่ยวข้องกับความปลอดภัยจากการใช้ถนน แต่อัตราการเกิดอุบัติเหตุในรอบสามสิบปีที่ผ่านมายังไม่สามารถลดลง การศึกษานี้มีวัตถุประสงค์เพื่อค้นหาว่ามีปัญหาอะไรที่ทำให้จำนวนอุบัติเหตุไม่ลดลง จากการทบทวน พรบ สามฉบับนี้ คล้ายคลึงกับประเทศที่พัฒนาแล้วหลายๆประเทศในหลายๆประเด็น แต่ข้อจำกัดที่พบได้แก่พรบ ควรจะมีการแก้ไขเพื่อให้สอดคล้องกับการเปลี่ยนแปลงที่เกิดขึ้นเช่น เทคโนโลยียานยนต์ขาดความต่อเนื่องจากการควบคุมการใช้ พรบ ขาดองค์ความรู้เพื่อสนับสนุนการพัฒนานโยบายและกฏหมายการบังคับควบคุมการใช้กฎหมายในประเทศไทยยังมีการกระจุกอำนาจอยู่มากซึ่งมีลบต่อการพัฒนานโยบายและกฏหมาย การศึกษานี้เสนอแนะให้เนื้อหาของ พรบ ควรมีการแก้ไข และ นโยบายควรปรับปรุงเพื่อทำให้เกิดความเป็นธรรมและประสิทธิภาพมากขึ้น
