Grievance System in Public Health Insurance Schemes Abstract A summary of the resource. การศึกษาครั้งนี้มีวัตถุประสงค์เพื่อศึกษาระบบการจัดการเรื่องร้องเรียนของโครงการประกันสุขภาพที่สำคัญๆ ในประเทศไทย รวมทั้งการพัฒนามาตรการและกลไกการดำเนินการเพื่อแก้ไขปัญหาที่เกิดขึ้น ผลการศึกษาพบว่ามีหลายโครงการประกันสุขภาพที่ประสบกับปัญหาในการให้บริการ ได้แก่ โครงการสวัสดิการรักษาพยาบาลของข้าราชการ โดยเป็นระบบที่ตั้งขึ้นมาเพื่อเป็นกลไกในการเบิกจ่ายเงินตามสิทธิของข้าราชการ ดังนั้นจึงเกิดปัญหาในเรื่องของคุณภาพการบริการและการร้องเรียนบ้างเล็กน้อยเมื่อเปรียบเทียบกับโครงการฯอื่น เพราะโครงการนี้ใช้กลไกการเก็บค่ารักษาพยาบาลแบบ fee for service แต่กลไกดังกล่าวก็ไม่ได้เป็นหลักประกันว่าจะไม่มีปัญหาคุณภาพของการให้บริการในปัจจุบัน โครงการที่สองคือ โครงการประกันสังคมดำเนินการภายใต้ พ.ร.บ.ประกันสังคม พ.ศ. 2533 และ พ.ร.บ. เงินทดแทน พ.ศ. 2537 พ.ร.บ.ทั้งสองฉบับไม่ได้มีข้อกำหนดเกี่ยวกับการร้องเรียน แต่โครงการประกันสังคมเป็นโครงการประกันสุขภาพโครงการแรกที่เริ่มมีระบบการรับเรื่องร้องเรียน ซึ่งจะถูกเสนอที่ผ่านไปยังคณะกรรมการแพทย์ดำเนินการสอบและตัดสิน รวมไปถึงเสนอบทลงโทษสถานพยาบาลในกรณีที่คณะกรรมการแพทย์ตัดสินว่าสถานพยาบาลเป็นฝ่ายผิด ซึ่งบทลงโทษจะเป็นแรงจูงใจให้สถานพยาบาลพัฒนาคุณภาพตามเกณฑ์ที่กำหนดไว้ สำหรับการลงโทษจะเริ่มจากการว่ากล่าวตักเตือน การภาคทัณฑ์โรงพยาบาลและแพทย์ผู้รักษา 1 ปี ตัดโควต้าผู้ประกันตน/ห้ามแพทย์ที่เกี่ยวข้องรักษาผู้ประกันตน/ส่งเรื่องให้แพทย์สภาพิจารณาดำเนินการทางจริยธรรม ไปจนถึงเมื่อมีความผิดที่รุนแรง ก็จะเสนอให้คณะกรรมการการแพทย์พิจารณายกเลิกสัญญา และโครงการ 30 บาทฯ เมื่อมีการร้องเรียนเกิดขึ้นในส่วนภูมิภาค สำนักงานสาธารณสุขจังหวัดจะพยายามไกล่เกลี่ยให้ก่อน ถ้ายังไม่ได้ข้อยุติในพื้นที่จึงจะส่งเรื่องต่อมายังส่วนกลาง ประชาชนสามารถสอบถามหรือร้องเรียนมายังสำนักบริการประชาชนที่ส่วนกลางโดยตรง ซึ่งสำนักงานบริการประชาชนจะทำหน้าที่ประสานไกล่เกลี่ยให้ แต่ถ้าเป็นเรื่องร้องทุกข์เกี่ยวกับมาตรฐานการรักษาทางการแพทย์ สำนักพัฒนาคุณภาพบริการจะนำเรื่องไปดำเนินการตรวจสอบหาข้อเท็จจริง เพื่อประกอบการพิจารณาของคณะกรรมการสอบสวนที่แต่งตั้งโดยคณะกรรมการควบคุมคุณภาพและมาตรฐานต่อไป และสุดท้ายคือ พ.ร.บ.คุ้มครองผู้ประสบภัยจากรถ พ.ศ.2535 ปัญหาส่วนใหญ่มักจากบริษัทปฏิเสธการจ่ายเงินหรือจ่ายให้ไม่ครบหรือล่าช้า ซึ่งผู้ประสบภัยหรือทายาทสามารถแจ้งที่ศูนย์รับเรื่องร้องเรียน ที่กรมการประกันภัย หรือที่สำนักงานประกันภัยภูมิภาค สำนักงานพาณิชย์จังหวัด เป็นต้น ซึ่งในบางกรณีที่เกิดพิพาทจะตัดสินโดยกระบวนการตัดสินข้อพิพาทในเรื่องกรมธรรม์ประกันภัยทั่วๆไป ( ซึ่งกรมการประกันภัยมักจะทำหน้าที่เป็นตัวกลางในการไกล่เกลี่ยในกรณีบางกรณี ) และถ้ายังไม่ได้ข้อยุติ ก็สามารถส่งเรื่องร้องเรียนไปยังคณะอนุญาโตตุลาการหรือกระบวนการทางศาลพิจาณาชี้ขาดต่อไป สรุปผลการศึกษาได้ว่าปัญหาที่เกิดขึ้นจากโครงการประกันสุขภาพต่างๆ มาจากการให้บริการที่ยังไม่ได้มาตรฐาน ถึงตัวโครงการจะมุ่งเน้นบริการเพื่อประชาชน แต่ก็ยังขาดการจัดการที่ดีและมีระบบ ดังนั้นเราจึงควรกำหนดบทลงโทษที่ชัดเจน เพื่อคอยควบคุมมาตรฐานในการให้บริการให้มีมากยิ่งขึ้น http://digital.nlt.go.th/dlib/files/original/1aca1786cfae9a1fd24c379c91f3673f.pdf ce931c509e1558bda6f91644a2f63e0f Dublin Core The Dublin Core metadata element set is common to all Omeka records, including items, files, and collections.
