Evaluation of the mission of National Health System Reform Office Abstract A summary of the resource. การวิจัยเรื่อง ”การประเมินพันธกิจสำนักงานปฏิรูประบบสุขภาพแห่งชาติ “ มีวัตถุประสงค์การวิจัย คือ 1) เพื่อศึกษาถึงปัจจัยที่มีผลต่อการผลักดัน (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติ และ 2) เพื่อการวางแผนในการจัดทำยุทธศาสตร์ในการขับเคลื่อน (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติ ในระยะเวลา 2 ปีข้างหน้า (พ.ศ. 2547-2548) กรอบแนวคิดในการวิจัยครั้งนี้ เป็นการใช้องค์ความรู้เรื่องการจัดการเชิงกลยุทธ์ โดยแบ่งเป็น 3 ขั้นตอนคือ 1) การวิเคราะห์กลยุทธ์ (Strategic Analysis) 2) การกำหนดทางเลือกกลยุทธ์ (Strategic Choice) และ 3) การนำกลยุทธ์ไปปฏิบัติ (Strategic Implementation) โดยในการวิเคราะห์กลยุทธ์เป็นการใช้เทคนิคการวิเคราะห์สภาพแวดล้อมภายนอกและสภาพแวดล้อมภายใน (SWOT Analysis) เพื่อประกอบการวิเคราะห์บริบทของ (ร่าง) พ.ร.บ.สุขภาพแห่งชาติ และการกำหนดทางเลือกกลยุทธ์ใช้ SWOT Matrix เพื่อวิเคราะห์หายุทธศาสตร์ที่เหมาะสมกับบริบท และนำเสนอมาตรการในการปฏิบัติ การศึกษาวิจัยครั้งนี้เป็นการศึกษาวิจัยเชิงคุณภาพ ด้วยการทบทวนและสังเคราะห์จากเอกสารที่เกี่ยวข้อง การสัมภาษณ์เชิงลึก และการสนทนากลุ่มย่อย ผลการวิจัยผู้วิจัยได้อาศัย ข้อมูลเชิงคุณภาพที่ได้มาทำการวิเคราะห์เชิงลึก (In-depth Analysis) การวิเคราะห์เนื้อหาสาระจากเอกสาร (Content Analysis) และการสังเคราะห์ข้อมูล (Focus Synthesis) ผลการศึกษาเกี่ยวกับบริบทของ (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติ พบว่า จุดเด่นของสาระใน (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติ คือ การบูรณาการทางความคิดเชื่อมโยงอย่างเป็นระบบเน้น การสร้างนำซ่อมที่อยู่บนพื้นฐานของความพอดี พอเพียง การมีระเบียบสำนักนายก รัฐมนตรีว่าด้วยการปฏิรูประบบสุขภาพ พ.ศ. 2543 รองรับการยกร่างกฎหมาย ความเชื่อมโยงกับรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2540 นอกจากนี้กระบวนการระดมความคิดเห็นเพื่อร่างพระราชบัญญัติที่เน้นการมีส่วนร่วมจากทุกภาคส่วนทำให้ประชาชนกลุ่มหนึ่งเกิดความรู้สึกเป็น เจ้าของ และเกิดเครือข่ายสุขภาพในทุกพื้นที่ทั่วประเทศ ขณะเดียวกันสำนักงานปฏิรูประบบ สุขภาพแห่งชาติ ซึ่งเป็นองค์กรที่มีความรับผิดชอบในการร่างพระราชบัญญัติเป็นองค์กรซึ่งจัดตั้งขึ้นตามระเบียบสำนักนายกรัฐมนตรีและมีภารกิจชัดเจน มีความเป็นอิสระสูง มีภาคีเครือข่ายที่หลากหลายเป็นผู้สนับสนุน และมีความพร้อมด้านทรัพยากรอย่างไรก็ตาม พบว่า (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติ มีข้อจำกัดในหลายประเด็น ทั้งในส่วนของสาระของพระราชบัญญัติ กระบวนการในการระดมความคิดและองค์กรที่รับผิดชอบ กล่าวคือ เนื้อหาของร่างพระราชบัญญัติมีความครอบคลุมกว้างขวางเกินไป มีความเป็นนามธรรมสูง ความขัดแย้งทางความคิดกับระบบเศรษฐกิจแบบเสรีนิยม เน้นหนักสิทธิของผู้รับบริการ แต่ไม่ครอบคลุมสิทธิของผู้ให้บริการ และบางมาตรามีความขัดแย้งกับโครงสร้างอำนาจทางสังคมและกลุ่มผลประโยชน์ นอกจากนี้ในส่วนของกระบวนการในการระดมกับความคิดเห็นเพื่อร่างพระราชบัญญัติฉบับดังกล่าว พบว่า การร่างกฎหมายมีข้อจำกัดในการประยุกต์ความรู้ทางวิชาการ ขาดความเชื่อมโยงระหว่างพระราชบัญญัติสุขภาพแห่งชาติกับพระราชบัญญัติหลักประกันสุขภาพแห่งชาติของรัฐบาล และจุดด้อยในส่วนขององค์กรที่รับผิดชอบในการร่างพระราชบัญญัติ คือ ข้อจำกัดเรื่องประสบการณ์ในการร่างกฎหมายโดยวิธีการระดมความคิดเห็นจากประชาชน และข้อจำกัดในการสื่อสารกับกลุ่มผู้มีส่วนได้ส่วนเสียซึ่งกระทำยังไม่เต็มที่สำหรับสภาพแวดล้อมภายนอกของ (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติ ในส่วนของโอกาสนั้น คือ ความตื่นตัวของประชาชนจากผลการปฏิรูประบบสุขภาพทำให้สามารถสื่อสารเรื่องสุขภาพได้ไม่ยาก ในส่วนของภาวะคุกคามนั้น คือ มติของคณะรัฐมนตรีที่เห็นว่า พระราชบัญญัตินี้ไม่มีความจำเป็นเนื่องจากมีกฎหมายฉบับอื่นอยู่ ประกอบกับโครงสร้างอำนาจทางการเมืองที่เข้มแข็งของฝ่ายรัฐบาล นโยบายประชานิยม ระบบเศรษฐกิจแบบทุนนิยมและการค้าเสรี ตลอดจนความพร้อมและความตระหนักของประชาชนเรื่องสุขภาพยังมีจำกัดสำหรับข้อเสนอแนะยุทธศาสตร์ในการผลักดัน (ร่าง) พระราชบัญญัติสุขภาพแห่งชาตินั้น คณะผู้วิจัยได้ทำการวิเคราะห์และกำหนดออกเป็นทางเลือกกลยุทธ์ 4 ทางเลือก ได้แก่ 1) การผลักดัน (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติฉบับเดิม โดยอาศัยยุทธศาสตร์การเข้าชื่อเสนอกฎหมาย 2) การปรับปรุง (ร่าง) พระราชบัญญัติสุขภาพแห่งชาติและทำการผลักดันเข้าไปใหม่ โดยการปรับปรุงเนื้อหาบางมาตราที่มีปัญหา หรือการยกร่างเฉพาะเนื้อหาที่เกี่ยวข้องกับองค์กร และกลไกเพื่อการผลักดันเนื้อหาในส่วนอื่นต่อไป 3) การผลักดันให้เป็นรูปแบบอื่นที่ไม่ใช่กฎหมาย โดยผลักดันเป็นนโยบายหรือแผนแม่บท และ 4) การขับเคลื่อนในภาคสังคม ซึ่งในทางเลือกที่สี่นี้สามารถดำเนินการพร้อมกับทางเลือกที่หนึ่งถึงสามได้ด้วย
